RE: The tariff classification of “PD-4012” pigment dispersion from Canada

Dear Mr. Dahm:

In your ruling request received March 9, 2015, on behalf of your client, Sealchem Industries Inc., you requested a tariff classification ruling on “PD-4012” pigment dispersion.

Your submission states that the product at issue is a black liquid, intended for use in epoxy systems. The provided Material Safety Data Sheet indicates that this product’s composition includes diglycidyl ether of bisphenol A, iron oxide black, and C12-c14 alkylglycidyl ether.

You have suggested subheading 3907.30, Harmonized Tariff Schedule of the United States (HTSUS); however, we have found that to be incorrect. The applicable subheading for “PD-4012” pigment dispersion will be 3206.49.2000, HTSUS, which provides for Other coloring matter; preparations as specified in note 3 to this chapter, other than those of 3203, 3204 or 3205; Inorganic products of a kind used as luminophores, whether or not chemically defined: Other coloring matter and other preparations: Other: Preparations based on iron oxides. The general rate of duty will be 6.5 percent ad valorem.
